Welcome to Welly Benefits (“Welly”, “we”, “our”, or “us”). These Terms of Service (“Terms”) govern your access to and use of our web application and services (the “Services”). By using Welly, you agree to be bound by these Terms. If you do not agree, do not use our Services.
1. Overview of Services
Welly provides employers with a platform to offer a primary care membership to their employees. This membership enables employees to access unlimited visits with direct primary care providers in Welly’s network, with minimal additional out-of-pocket expenses for covered services.
Covered services may include (but are not limited to):

Routine office visits and checkups

Telemedicine and same-day care

Chronic disease management

Minor procedures and urgent care

Women’s health and pediatric services
-
Vaccinations and lab screenings (excluding lab costs)
Welly itself does not provide medical care. All medical services are offered by independent, licensed health care professionals.
2. Eligibility
You must be:

An employer located in the United States to create a Welly business account, or
-
An employee of a participating employer with access to Welly via invitation.
You must be at least 18 years old to use the Services.
3. User Accounts
Employers and employees will be required to create an account to use the platform. You agree to provide accurate information and to keep your login credentials secure. You are responsible for all activity under your account.
4. Fees and Payment
Employers are billed monthly for:

A flat platform fee, and
-
A flat per-employee primary care membership fee for each participating employee.
All payments are handled via monthly invoice through third-party services such as Stripe. By using Welly, you agree to their terms and policies.
5. Use of Services
You agree to use Welly only for lawful purposes and in accordance with these Terms. You may not:

Misuse or interfere with the platform

Reverse engineer or hack the Services

Use Welly for unauthorized or illegal activities
6. Third-Party Services
Welly uses third-party tools such as Stripe, Typeform, and WordPress to deliver its services. These third-party services are governed by their own terms and privacy policies.
7. Disclaimers

Welly does not guarantee the quality of care or outcomes from the providers in our network. All care is provided by independent health care practitioners.

Welly does not guarantee that all providers in a geographic area are included in our network. Network coverage may vary.

Welly does not provide medical advice. Any medical questions should be directed to a licensed provider.
8. Limitation of Liability
To the maximum extent permitted by law, Welly shall not be liable for any indirect, incidental, special, or consequential damages arising from or related to your use of the Services.
9. Termination
We reserve the right to suspend or terminate your access to the Services at any time, without notice, for violations of these Terms or other misuse.
10. Modifications to These Terms
We may update these Terms from time to time. We will notify users of material changes by email or through the platform. Your continued use of the Services constitutes acceptance of the updated Terms.
11. Governing Law
